Our firm represents developers, construction companies and joint ventures involved in the Construction Sector. We advise on all forms of construction and civil engineering contracts including RIAI, IEI, NPSC and FICIC standard contracts for large Commercial Offices Retail Student Accommodation Schemes, Hotels and Tax based Holiday Homes.
We adapt the contracts for each project. The use of a Design and Build Contract for both the Developer and Builder can for some projects provide a practical solution for both parties. In some projects we can arrange Finance where the eventual end user is known. We ensure that important clauses to deal with issues which are know in advance such as Cost Over Runs, Ground Preparation and Conditions, Collateral Warranties, Time Delays and Planning Issues are included in the standard agreements. Early meetings before contracts are signed are always advised to deal with these and many more project specific issues. We work with our clients to try to ensure issues are covered in the contract to avoid disputes.
Disputes will always arise and our ethos is to ensure that our clients’ disputes are handled in the most cost effective way whilst tailoring the choice of resolution process to one which works on a practical level. In construction and engineering projects the most important aspects can be to minimise conflict to enable all the parties to continue working together, to keep communication channels open to successfully complete the project and to preserve future working relationships between the parties. We have a track record in assisting speedy resolution which is vital for our clients’ projects.
In the event resolution cannot be achieved we will advise swift action in either taking or defending in Mediation , Arbitration, Conciliation or Alternative dispute mechanisms or at a last resort court proceedings.
