We are pleased to note Mr. Justice Dennis McDonald in the High Court found in favour of four primarily Dublin Pub Owners, to be compensated by FBD Insurance for the disruption to their business suffered due to the Covid-19 pandemic. The Judge found that where the closure is promoted by nationwide outbreaks of the disease within 25 Mile radius of the premises they were entitled to succeed. The issue of quantifying the losses would be dealt with at a later date.
The test cases were taken by the Public Houses known as, Sinnotts Bar, The Leopardstown Inn, Inn on Hibernian Way and Sean’s Bar in Athlone. This is welcome news for at least some of the Publicans, but it is disappointing to see the attitude of the Insurance Companies at this time when many of these businesses are struggling to survive, this is when they should be supported the most and not have to resort to legal action to enforce their rights.
